SALT LAKE CITY- One woman says she’s waited long enough, and she’s taking a well-known Hollywood actor to court.  She claims the actor fondled her 15 years ago when she was only 11 years old.

Tom Sizemore is known for being in movies like “Heat” and “Saving Private Ryan.”  This case stems from an alleged incident that happened on the set of “Born Killers” in 2003.  Kiersten Pyke was cast as Sizemore’s daughter, and they were scheduled to pose for pictures that would be used in the film.  Pyke claims Sizemore placed his hand under her clothing, and moved with her as she tried to wiggle away.

Pyke says they were scheduled to take more pictures after that.

“I remember him trying to kiss me, and they would say, ‘Kiss daddy! Give daddy kisses!’ I was just, ‘I don’t want you nasty, sweaty upper lip on me,’” she says.

She claims she can remember the event vividly, and she can recall looking to her mother for help, but, her mother seemed to not understand the message Pyke was trying to convey.  For years, Pyke believed her parents did nothing to help her deal with what happened, but, she says her parents recently told her they confronted Sizemore at a dinner.

“My parents came to me in tears and said, ‘Sweetheart, you don’t know, do you?’  They said, ‘We tried.’  My dad got a hold of two different police departments and filed two different police reports,” she claims.

Pyke says her parents were told that if they were to take the matter to court, Pyke would be dragged through a long court process.  Her parents decide not to pursue the matter after that.

However, her attorney, Robert Sykes, says there are people who can corroborate that something happened on the set.  He says a casting director can confirm Sizemore was fired from the movie, then rehired.

“I’ve interviewed some people that were on the set that confirmed it to me,” Sykes says

He adds that they’ve tried to settle this case out of court, however, talks between him and Sizemore’s attorney have fizzled.

Sykes says, “We were trying to get this case resolved without filing [a lawsuit.]  If I could have done that, I would have loved to not file this case and not brought any more psychological difficulty on my client.”

The actor’s representatives have told The Hollywood Reporter that they have no comment at this time, but, he has denied the allegations in the past.  Prosecutors declined to press charges due to problems with witnesses and evidence.
