Convicted felon shoots himself and crashes car while driving intoxicated, police say

PROVO – A convicted felon crashed his car Friday after shooting himself while driving intoxicated, according to the Provo Police Department.

According to the booking affidavit, police responded to a welfare check on a man, later identified as 34-year-old Oscar Diaz, who seemed to have a cut on his forehead.

It was later discovered the cut was actually a gunshot wound to his forehead, according to the affidavit.

While talking to his family, police said they found Diaz had been drinking and was located at the Waffle-Love in Provo.

The affidavit stated that other officers were also dispatched to a car crash in the same area.

Upon arrival, police said they found Diaz pacing around while his white Nissan Altima was involved in a single-vehicle accident.

Diaz was transported to the Utah Valley Hospital to be treated for his gunshot wound, according to the affidavit.

The Provo PD searched his car to allegedly find a bottle of alcohol, marijuana, and other paraphernalia.

Diaz was read his Miranda rights while in the hospital and asked how the gunshot wound happened. Police said Diaz was holding his friend’s firearm when he looked down the barrel and accidentally fired the weapon.

Allegedly, Diaz said spoke to his family in person after it happened but was never taken to the hospital.

The affidavit stated that a blood and urine sample found positive results of, THC, alcohol, methamphetamines, and ecstasy in his system.

The Provo PD said Diaz is a convicted felon who was driving a vehicle without a mandated interlock device.

Diaz was arrested for charges of possession of a firearm by a restricted person, driving under the influence, and three counts of possession of a controlled substance, according to the affidavit.
