4 Roy police officers won’t be charged with sexual assault, according to Salt Lake County DA

SALT LAKE CITY — The Salt Lake County District Attorney will not charge four Roy police officers with sexual assault.

The officers were placed on administrative leave after an incident on May 14, at Snowbird Ski Resort. At that point, the Salt Lake County Sheriff’s Office issued a statement which said the officers had responded to a medical emergency. Later, the sheriff’s office said they were investigating a sexual assault.

In a letter to the Salt Lake County Sheriff’s Office dated June 25, officials said they had determined that “a declination of charges in this matter is appropriate.”

“The rationale for the declination of the case is based on the belief that the State is unable to prove the suspects in this matter knew or should have known that (the complainant) could not
consent to the activity appearing to be sexual in nature in the hot tub video,” the DA’s office said in the letter.

The DA office said there is “insufficient evidence” that sexual activity continued in the locker rooms or sauna while the complainant was unconscious. 

But the letter also indicated that the DA’s decision should not be construed as doubting a claim made by the complaint. 

“The declination to file this case should not be construed as our office doubting the veracity of (the complainant)’s claims, but that the State is unable to meet the high burden of proof beyond a reasonable doubt,” the DA’s office said. 

Sgt. Josh Taylor with the Roy Police Department told KSL that since the criminal investigation is complete, the department will conduct its own investigation. 

Taylor said that while there were originally four officers under investigation, one officer was cleared soon after the criminal investigation was announced.

The three other officers are still on administrative leave as the department investigates.
