SANTA CLARA, Utah– The Utah Little League baseball player injured after falling from a bunk bed in August returned to his southern Utah home Monday night, and at the same time the boy’s family has filed a lawsuit.

Easton Oliverson’s family posted on Instagram that he made it home for the first time since the fall that hospitalized Easton last month.

Easton’s parents spoke with Good Morning America this week.

“There were many moments these past few weeks where we didn’t think he would ever be able to come home,” said Easton’s father,  Jace Oliverson.

The family used the post to ask people for their prayers. Easton’s road to recovery will be a long one, they said.

“We’re so proud of how far he’s come and how hard he has worked. But, he definitely has a lot more work to do,” said mother Nancy Oliverson.

Utah family files lawsuit against Little League Baseball, furniture manufacturer

Easton’s family has filed a lawsuit against Little League Baseball. Also named in the lawsuit is Savoy Contract Furniture, the manufacturer of bunk beds for Little League Baseball.

Court documents allege negligence on the part of the defendants. The family claims that Easton’s bed did not have a rail and that it should not have been placed in the Pennsylvania dorm where the Snow Canyon All-Stars were staying.

The family is seeking $50,000 in damages.

On Tuesday, Kevin Fountain with Little League International said they could not comment on pending litigation.
